These Terms and Conditions ("Terms") govern your use of the Black Stack Diesel website (black-stack-diesel.com), mobile application, and related services (collectively, the "Services") operated by Dynamic Innovative Solutions LLC, doing business as Black Stack Diesel ("we," "us," "our").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our Services.
1. About Black Stack Diesel
Black Stack Diesel is an independent diesel parts retailer based in Winona, Missouri. We source products through authorized distributors, including APG (Premier Warehouse Distributors), and use ASAP Network for product data syndication. We are not directly affiliated with the individual brands whose products we sell. All brand names, logos, and trademarks remain property of their respective owners.
2. Account Registration
To purchase products through our Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration, and to update your information as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3. Product Information and Pricing
We strive to provide accurate product information, including descriptions, specifications, fitment data, and images. However, we do not warrant that all product information is error-free, complete, or current. Prices, availability, and product specifications are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including pricing or availability errors.
Fitment information (year, make, model, engine compatibility) is provided as a guide. Customers are responsible for confirming that products will fit their specific vehicle before purchase. We recommend consulting a qualified mechanic or the part manufacturer for fitment questions.
4. Orders and Payment
By placing an order, you make an offer to purchase the product(s) at the listed price. We accept orders subject to verification, availability, and payment authorization. Payment is processed through Stripe at the time of order. Order confirmation does not guarantee fulfillment until shipped.
Payments. BSD accepts all major credit and debit cards (Visa, Mastercard, American Express, Discover). All payments are processed securely by Stripe; BSD does not store payment card information. Stripe handles payment data per PCI-DSS standards.
5. Shipping
We currently ship within the United States only. Shipping timeframes and carriers vary by product and supplier. For specific shipping questions, contact us at help@black-stack-diesel.com.

7. Intellectual Property
The Services and all content (including but not limited to text, graphics, logos, images, software, and design) are the property of Dynamic Innovative Solutions LLC or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written permission.
Third-party brand names, product names, and images displayed on our Services remain the property of their respective owners and are used for product identification only.
8. AI-Assisted Diagnostics Disclaimer
Black Stack Diesel offers AI-assisted diagnostic features ("BSD AI") to help customers research vehicle issues and identify relevant parts. BSD AI provides general information only and is not a substitute for professional mechanical diagnosis or repair. Information provided by BSD AI may be incomplete or inaccurate. We are not responsible for decisions made based on BSD AI output. Always consult a qualified diesel mechanic for actual repair work.
9. Limitation of Liability
To the maximum extent permitted by law, Dynamic Innovative Solutions LLC and Black Stack Diesel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or use, arising out of or in connection with your use of the Services.
Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid for the specific product or service that is the subject of the claim.
10. Product Use and Vehicle Modifications
Many products sold through Black Stack Diesel are intended for off-road, racing, or competition use only and may not be legal for use on public highways under federal, state, or local emissions laws. Some products may not be CARB-compliant or may void manufacturer warranties.
You are responsible for ensuring that any product you purchase complies with applicable laws in your jurisdiction. Black Stack Diesel makes no representations regarding the legality of any product for on-road use in any specific jurisdiction.
11. Indemnification
You agree to indemnify and hold harmless Dynamic Innovative Solutions LLC, Black Stack Diesel, and our affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Services.

We may update these Terms at any time. We will indicate the "Last updated" date at the top of this page. Continued use of the Services after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in Missouri.
